By proceeding with a purchase or using this website, you agree to be bound by these terms. 1. Merchant of Record Our order process is conducted by our online reseller, Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all orders placed through this website. They are responsible for processing payments, handling applicable sales tax, and managing initial customer service inquiries and returns. 2. Software Licensing Upon purchase, Neptune Navigation Software grants you a non-exclusive, non- transferable license to use the Neptune Chart Packs and software for personal or professional use, subject to the specific license type purchased. Ownership: All rights to the program, including text, graphics, and source code, are retained by the developers. Usage: While some software may permit installation on more than one device, this is strictly for the exclusive use of the individual purchaser. Restrictions: You may not redistribute, resell, decompile, or reverse-engineer any software or maritime chart data provided. 3. Maritime Disclaimer & Fitness for Purpose Navigational Warning: While we strive for 100% accuracy in our maritime data, our products are provided "as is." They must be used only as a supplement to, and not a replacement for, official navigational tools and certified paper charts. User Responsibility: It is the user's responsibility to ensure the product is applicable to their needs. We recommend using available downloads to test compatibility before purchase. Technical Performance: Due to the nature of third-party software and varied PC environments, we only guarantee performance on a "clean" Windows installation on our standard test hardware. We do not undertake to debug or rectify issues on a user's specific device or third-party hardware. 4. Returns and Refunds Refund requests via Neptune Navigation Software will be handled through their Lemon Squeezy portal, as Lemon Squeezy, being the Merchant of Record, manages the financial processing of online sales. Compatibility Issues: If a product is found to be incompatible with your hardware, Neptune Navigation may, at it’s discretion, offer a refund provided the software is fully removed from all PC's associoated with the buyer Physical Goods: Stock products (hardware or media) may be returned within 7 days if they remain in undamaged condition. Disputes In the event of any dispute, you must make your complaint to Neptune Navigation in writing, to the address on the Contact page. If it is not possible to resolve the dispute by negotiation, the matter shall be determined under the laws of England and Wales.
